Standardization and Nature Conservation – Wind Energy onshore

Project title: Nature Conservation and the Energy Transition – Options for Standardization and Simplification: onshore wind energy

Focus

  • Standardization of the disturbance and killing prohibitions for birds (in aggregations), repowering, and bat protection
  • Maintaining the nature conservation protection level
  • Support for federal statutory and subordinate regulatory and concretization needs

Departmental Research Plan 2026
Term: 01.09.2026 – 30.04.2029

The objective of this project is to develop professionally derived proposals for standardization in the field of onshore wind energy, covering the topics of the disturbance prohibition for birds, protection measures, the prohibition of killing birds in aggregations, repowering, and bat protection. These proposals are intended to form the basis for federal statutory and subordinate regulatory needs and for concretization requirements regarding the safeguarding of nature conservation concerns within efforts to accelerate and simplify the permitting of onshore wind energy installations.

Research question / project objectives

The project develops professionally sound recommendations for uniform standards for the nature-compatible expansion of onshore wind energy. When considering species protection law in planning and permitting procedures, the aim is to ensure a high level of protection for affected species alongside the intended simplification and acceleration.

The focus includes, among other things, the assessment of disturbance to bird species, the handling of bird aggregations under the killing prohibition, the concretization of existing protection measures, rules for repowering projects, and shutdown concepts for bat protection.

The results are intended to serve as a basis for future technical and legal regulations. The goal is to reduce existing uncertainties and obstacles in considering species protection law, facilitate implementation in practice, and thereby support faster and nature-compatible expansion of renewable energy. In the context of the project, current initiatives at EU level, in particular the so-called Omnibus Package VIII, must be taken into account.

Approach

To develop practical and professionally sound recommendations, existing expert proposals and guidelines, as well as findings from specialist literature, planning practice, and case law, are collected and evaluated. The topic areas "protective measures for bird species sensitive to wind energy" and "bat protection at wind turbines" are discussed and developed further in specialist workshops.

  • Proposals for standardizing the handling of the species protection prohibition on disturbance for birds
  • Practical recommendations and guidance on the design and application of protective measures under Annex 1, Section 2 of the BNatSchG (Federal Nature Conservation Act)
  • Proposals for standardizing the handling of the killing prohibition for birds in aggregations
  • Status analysis on repowering: approaches for applying the so-called Delta test under Section 45c(2) BNatSchG
  • Exploratory study on bat protection at wind turbines: collection, comparison, and presentation of options for action regarding existing shutdown requirements
